SECTION 13 – PAYMENT

All Payments are in USD. We accept payments via Stripe (Visa, Mastercard or American Express).

For EU customers a VAT tax is added to the price based on the billing location of the EU customer. This vat is set by your country and required by EU law. VAT tax is collected and turned over quarterly through the EU non-union MOSS scheme.

SECTION 14 – COPYRIGHT

You retain the copyright to data, files, graphic logos and graphic artworks that you provided to us, and grant us the rights to publish and use such material to create the deliverables (images, videos, or other products we offer). You must obtain permission and rights to use any information or files that are copyrighted by a third party. You are further responsible for granting us permission and rights for use of the same and agree to indemnify and hold us harmless from any and all claims resulting from your negligence or inability to obtain proper copyright permissions.

Any products or services produced by us and bought on https://www.smartershots.com shall remain our intellectual property. We grant you a non-exclusive image usage right and license to use the images we made for you. We will not distribute or sell the images we created with your branded products but we might reuse the background images and 3D scenes we used in the creation of your images.

SECTION 15 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk.
